Awards enormous legal fees to foreclosure lawyers
SB 1890: Lines 405 - 410
Awards attorney fees of 3% (So a $100k foreclosure gets $3000 and a $1,000,000 foreclosure gets $30,000 for exactly the SAME amount of work) -
Waives your right to trial in court
SB 1890: Lines 436 - 449
Allows the court to waive your right to trial if they deem you are trying to avoid your day in court. A fundamental right should never be "deemed" to be waived! -
Limits compensation of homeowners that have been mistakenly foreclosed upon!
SB 1890: Lines 231 - 290
This basically says that if the bank illegally forecloses on your home, you cannot get your home back once it has been sold to a new buyer. You are limited to only get a monetary compensation. -
Lets the banks "off the hook" from having to pay Condo Association's legal fees related to the foreclosure, but those that buy through short sale are still "on the hook". This sticks it to the Condo association (and the unit owners) to benefit the banks.
